Confidentiality Questions

As explained in our Notice of Privacy Policies, there are
certain situations where the laws dictates that certain information disclosed during counseling must be disclosed
to the appropriate authorities.
If you choose to file a claim with an insurance company, current HIPAA Laws (Health Insurance
Portability and Accountability Act) that is completely your choice. However, as allow Dr. Tim
Gardner is not an approved provider for any insurance company (by our choice) (See Insurance Questions), he will not disclose any information to them, even
with your consent. I simply do not deal with insurance companies.
In the rare case I am instructed by a court of law to disclose information on you, I
will only disclose the information on your PHI (Diagnosis, treatment plan, session updates) but I will not
disclose the contents of case notes that we have made for our sessions with you.
Members of the counseling profession have fought hard to gain the Psychotherapy Note Exemption
which allows psychotherapists to keep private session notes if they are kept separately from a patient's PHI.
At our practice, we maintain separate PHI files and psychotherapy note files. Again, this provides extra
protection and privacy for you in the event details of your treatment must be disclosed.
